Il 22 marzo 2012 è stato pubblicato in Gazzetta il D.Lgs. 2 marzo 2012 n.24 per l'attuazione della Direttiva 2008/104/Ce del Parlameto Europeo e del Consiglio del 19 novembre 2008, relativa al lavoro tramite agenzia interinale.
Con un articolato Disegno di legge, composto da circa 70 articoli, il 4 aprile scorso il Governo ha presentato il progetto di riforma del mercato del lavoro. Tra gli aspetti di maggiore rilevanza del progetto si segnalano le modifiche all'art.18 della L. n. 300/1970 ed in particolare la possibilità che reintegrazione nel posto di lavoro possa essere comunque disposta dal giudice in tutti i casi in cui venga accertata la non sussistenza del motivo. Dopo un periodo di incertezze è stata ufficializzata dal Governo la proposta in tema di flessibilità in uscita e tutele del lavoratore. L'aspetto più innovativo che emerge dalla proposta consiste nell'aver disegnato un sistema di tutele specifico e ripartito per le diverse tipologie di licenziamento, valorizzando, al contempo la tutela risarcitoria, elevata a sanzione "esclusiva" nelle ipotesi di licenziamento per giustificato motivo oggettivo e a "concorrente", rispetto alla reintegra, nelle ipotesi di giusta causa e giustificato motivo soggettivo.
